Tier 2 (Intra-Company Transfer) Visas are for employees of multinational companies whose employers require them to transfer into a UK branch or subsidiary, either to fill vacancies that cannot be filled by a settled worker or for training purposes.
Employers wishing to move an employee into the UK must have a sponsor licence and there are two sub-categories for Tier 2 (ICT) visas: long-term staff or graduate trainees.
Long-term staff must have worked for the sponsoring employer for at least one year, unless they will earn £73,900 per year or more. This visa is also only valid for roles that cannot be filled by a current UK resident, which needs to be proven by the organisation before the candidate can apply for the visa.
Graduate Trainees must be recent graduates and have worked for their employer for at least 3 months. They can only migrate to the UK if they are transferring into a graduate trainee programme for a specialist role in a structured graduate training programme with intent to progress to a management or specialist role.
Before applying for a Tier 2 Intra-Company Transfer, the employee must:
- Be employed by an organisation that has a British work sponsor licence and been given a certificate of sponsorship (COS) number
- Have been offered a role by the company
- Qualify for either a long-term staff or graduate trainee visa
To apply for a Tier 2 (Intra-company Transfer) visa, the migrant must be able to supply a range of evidence that supports their application including a passport or equivalent travel document, evidence of maintenance (funds) as well as further supporting documents depending on the role, salary, or if they’re bringing dependents, etc.
The application process for a Tier 2 Intra-Company Transfer can be complicated and the British immigration system has strict timelines and requires correct supporting evidence. It’s advisable to work with an experienced UK immigration lawyer to ensure you are not wasting expense and to ensure a successful application.
